TERMS AND CONDITIONS
1. Introduction
These terms and conditions (hereinafter referred to as "Terms") are the Terms which apply when the customer accesses our website www.argoingshop.it (hereinafter referred to as "Website"), or places an order to purchase any of the products made available to the customer on our Website.
The Customer, by using this site and by placing an order, agrees to be bound by the following Terms, and, in the case that the User can be qualified as a consumer, by the provisions of the Consumer’s Code (Legislative Decree. No. 206/2005), section II (Arts. 50-67).
We recommend the customer to keep a copy of these Terms for future reference.
Each purchase order for Products displayed on the Website implies the reading and express acceptance of these Terms, even without a handwritten signature of the Customer. The submission of the order form, as provided in article 7 of these Terms ("Insertion and confirms orders"), constitutes for all legal purposes a contract of sale between Argoing s.r.l. and the Customer, from which arise the mutual rights and obligations governed by Italian civil law.
The individual user declares that he is at least 18 years old.
Changes to Terms and Conditions
Argoing s.r.l. reserves the right to change and/or modify these Terms at any time. Consequently, we invite you to check any change that may occur. If the Customer does not agree to any of the Terms then the customer can simply stop using the Website at any time. If the Customer has any questions, concerns and/or comments about our Terms it can contact us at info@argoingshop.it.
2. Content of the Websit
All content displayed on the Website (“Content”) is owned by Argoing s.r.l. and is protected by Italian, EU and international copyright, trademark, patent, or other intellectual property laws. Argoing s.r.l. owns the copyright in the selection, compilation, assembly, arrangement, and enhancement of the Content on the Website.
3. Use of the Website
Subject to the customer’s compliance with these Terms, we grant the Customer permission to download, display, view, use, and/or print sections of the Website for the customer’s personal, non-commercial use only. Any other use is strictly forbidden without prior approval of Argoing s.r.l..
4. Products and pricing information
Products that Argoing s.r.l. offers for sale are those listed on the Website on the date on which the Customer consults the Site within the limits of the available stock of the suppliers.
Price and availability information is subject to change at any time, without notice and at our sole discretion. We make no representations or warranties about the accuracy or completeness of the information on the Website. There may be information on the Website that contains typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, promotions, offers, and availability. We reserve the right to correct any errors, inaccuracies or omissions and to change or update information or cancel orders if any information on the Website is inaccurate. We have made every effort to display product colours as accurately as possible, however, we cannot guarantee the display of any such colour on customer’s particular computer monitor or device will be accurate
Argoing s.r.l. cannot be held responsible for payments due for any products ordered on the Website by the Customer. If we do not receive payment from the customer’s credit issuer or its agents, the customer agrees to submit the payment to us in full. The Customer shall be responsible for any costs of collection for overdue payments.
Delivery costs are properly indicated at the time of the order. The cost for each shipment will vary depending on the mode of delivery and payment, as well as on shipping’s destination and on the amount of the order.
5. Insertion and confirmation of the order
On the Website the Customers can view and select the products sold by Argoing s.r.l.. The Customers can freely consult the pages of the Website, without any purchase obligation.
The sale and purchase agreement will be formed through the exact filling of the single boxes of the purchase request and the subsequent submission of the same together with the consent, after its reading, of the printable summary of the order, which lists: Customer’s data, description and price of the purchased products, shipping costs, terms of payment transaction costs, delivery address and the expected delivery time.
Argoing s.r.l. will confirm the formation of the agreement with an automatic response sent to the email address indicated by the Customer and it only confirms the correct reception of your proposal through the information systems. This confirmation message indicates an "Order Number" to be used in any subsequent communication directed to Argoing s.r.l.. Beside the information required by law, the confirmation message will show all inserted data relating to he Customer, who commits to verify their correctness and to promptly communicate any correction. Any surcharge of the costs caused by unreported errors will be borne by the Customer.
6. Payment methods
All payments must be immediately made through the website.
Debit and Credit cards – After that the customer creates an order, the customer is redirected to a secure payment bank gateway, where the customer will enter the necessary payment data. This method of payment of the purchase price is considered an advance payment. We would also like to inform the customer that our employees do not have access to the data of the customer’s card. All is exclusively in the hands of the bank.
PayPal - after the customer creates an order, the customer is redirected to a secure PayPal gateway, where the customer logs in to customer’s PayPal account to complete the purchase. We would like to inform the customer that Argoing.it does not have access to customer’s PayPal account, or any other information related to customer’s PayPal account.
In order to protect the customer and Argoing s.r.l. from fraud, we only ship items to confirmed PayPal addresses linked with the customer’s PayPal account. If the customer is not sure if its address is confirmed, the customer is invited to visit the PayPal link provided and follow the steps to verify if its address is confirmed.
7. Shipment and delivery
We are doing our best to ship each delivery as soon as possible. For delivery times in Italy, please allow approximately 15 business days after shipment; in any case, orders will be delivered within 30 days, according to the product origin and the kind of service required by the User, which run from the date of his order confirmation.
Shipment will be sent to the address indicated at registration or at purchase by the User, who is obliged to indicate a valid address.
8. Sales tax
All prices and products are listed in Euros and include VAT taxes.
9. Return policy
All products supplied by us match the description given on this Website.
If a delivered product is defective or dysfunctional, please note that the Customer who cannot be qualified as a Consumer in accordance with the Consumers Code can ask the authorisation to return the product to the following e-mail address info@argoingshop.it within 30 days and ask either a refund or the replacement with another product of the same economical value. This 30 days period runs from the day after the customer received its order.
In the case defective or dysfunctional products are delivered, Customers who can be qualified as Consumers in accordance with the Consumers Code are entitled to ask the authorisation to return the product to the following e-mail address info@argoingshop.it within 2 months and ask either a refund or the replacement with another product of the same economical value. This 2 months period runs from the day the defect or dysfunction is discovered.
Please contact us in the case a damaged product is delivered; please send any photographical evidence to support your claim for damages.
In the case that the above-mentioned terms are complied with, Argoing Customer service will either re-accredit or submit another order to replace the defective material. In no case Argoing s.r.l. will be held responsible for any direct or indirect damage caused by a wrongful use of the products.
The return shall comply with the following procedure: sending of the defective product, which you asked the authorisation to return, to the address shown on the package you received through courier. The defective product must be returned to Argoing s.r.l. in its original packaging, together with the tag which is located on the bottom of the invoice and of the delivery note. The product shall be returned in its entirety and complete with any additional component, under the same conditions and in the same composition as it was packaged and dispatched.
Shipping costs will be paid by Argoing s.r.l. only when the decision to return the products results from an error of Argoing s.r.l..
All products are guaranteed according to the warranty of the respective supplier.
Argoing s.r.l. doesn’t grant refunds or exchanges for products that have caused an allergic reaction. If the customer feels an allergic reaction by using the product we invite the customer to stop using it immediately. Argoing s.r.l. isn’t liable for the allergic reactions caused by its products. Argoing s.r.l. is not responsible for any individual reaction to any particular ingredient. It is customer’s responsibility to know which products or ingredients he or she is allergic to.
If the customer wants to return the damaged or defective product, Argoing s.r.l. organizes the collection by a courier. Please note that the collection can be programmed only once. In case of collection without success the return shipment will be paid by the customer.

10. Withdrawal
The User who can be qualified as a Consumer in accordance with Legislative Decree no. 206/2005 (Consumer Code) has the right to withdraw from the contract without giving any reason in accordance to the conditions set out below. Therefore, what follows does not concern relations with Users who cannot be qualified as Consumers; such relations will be governed by in force law on withdrawal and termination of contract.
The Consumer Customer has the right to withdraw from the contract within 14 days from the date after the day of the product delivery and is entitled to a reimbursement of the price even if the product is not defective.
The right of withdrawal is limited and has to comply with certain terms (please see here below).
The exercise of the right of withdrawal may be communicated to the e-mail address info@argoing.it or by registered letter A / R to be sent to the address Argoing S.r.l. – 24058 - Romano di Lombardia (BG), in via G. da Romano, 1.
The right of withdrawal is subject to the condition that the product must not be used and must be returned in its original packaging, as above specified. The product shall be returned in its entirety and complete with any additional component, under the same conditions and in the same composition as it was packaged and dispatched.
The Customer that exercises his right of withdrawal must return the purchased product without delay and in any case within 14 working days from the date in which he had noticed the decision to withdraw.
In case of cancellation of an order consequently to the exercise of the right of withdrawal, shipping costs are paid by the Customer.
It will not be possible to exercise the right of withdrawal for sealed products, which cannot be replaced for hygienic or health-related reasons and that have been opened after the delivery.
Argoing s.r.l. processes the cash refunds within 30 working days which run from the date on which it has received back the purchased product; this will only happen after checking that the procedure was followed and the both the packaging and the product in its entirety are original.
The product must be returned to in its original packaging, together with the tag which is located on the bottom of the invoice and of the delivery note.
We invite the customer to take reasonable care of the product before returning it - particulary, the products mustn’t have been damaged.

11. Sales
Customers who cannot be qualified as Consumers in accordance with legislative decree n. 206/2005 and, consequently, purchase as professionals can enjoy a facilitated purchase rate since they have a VAT number.
In order to access this rate, it will be necessary to insert the company name or company title, and the VAT number, at the time of registration on the Site and, consequently, a sales code will be provided.
12. Force Majeure
Neither Party shall be liable for the total or partial non-performance or delay in performance of its obligations under this contract that is caused by an event that cannot be prevented (Force Majeure).
The force majeure event may include: wars, riots, insurrections, serious disorder in securing the Internet, technical failures, unauthorized access and/or intrusion on the website, strikes of any kind, telematics or telephonic faults. The abovementioned list is given merely as an example.
13. Applicable law
These Terms and conditions and all contractual relationship between Argoing s.r.l. and the Purchaser shall be governed by Italian law.
For any contract-related claim that may arise, Users can benefit from an out of Court procedure, in accordance with art. 141 ff. of the Consumers Code. In the case that the User seeks such procedure, we guarantee our attendance to meetings to reach an amicable settlement which can take place before RisolviOnline, an independent and institutionalised service provided by the Milan Chamber of Commerce.

14. Personal account
We are pleased to make it easier for the customer to order products using our Website, so we offer the customer the opportunity to register for a personal account. If the customer takes advantage of this opportunity, any personal data that the customer provide us with during the registration process will be stored in our database and will not need to be re-entered with each new order - it will be entered into the order form automatically.
To register, the customer must supply us with the online registration form. The customer can access, update or correct its personal account details through the "My personal information" button. We will only use the stored data in accordance with our Privacy Policy.
The Customer is responsible for maintaining the confidentiality of his password and user name and for all activities that are carried out under them. We do not have the means to check the identities of people using the Website and will not be responsible for losses when customer’s password or user name is used by someone else unless this is due to our negligence. The customer agrees to notify us immediately by email info@argoingshop.it if it becomes aware or suspect of any unauthorized use of its password or username.
15. Protection of confidentiality and data processing
Argoing s.r.l. protects the privacy of its Customers and ensures that data are processed in accordance to the provisions of LD. 2003/196. Personal data, (biographical and fiscal) are collected by Argoing s.r.l. (data controller), directly and/or through third parties, and are processed in printed, computing and telematics form, according to information released on www.argoingshop.it.
The Customer can assert the rights under Art. 7 of Leg. 196/2003.
16. E-invoice
The Customer will receive through e-mail communication, the digital invoice, which can be downloaded at any time. The digital invoice is also accessible from the section from customer’s client, or can be ordered writing to info@argoingshop.it.
17. Partial invalidity of the contract
If any provision of these Terms shall be held to be invalid, illegal or unenforceable, or had been found as such by law, regulation or Court, all remaining provisions shall remain fully valid.
