General conditions of Sale
1 . Introduction
The following general terms and conditions of sale (hereinafter referred to as “Terms”) will be applied when the User accesses the website www.argoingshop.it (hereinafter, “Site”) and at the moment in which the User himself places an order for the purchase of one of the products on the same site.
The User, when accessing the website and ordering a product, agrees to be bound by the following Terms and Conditions, and, if the User also has the status of consumer, the provisions of the Consumer Code will apply (Legislative Decree . nr. 206/2005), section II Distance contracts (articles 50 – 67).
We recommend that you keep a copy of these Terms for future reference.
Each purchase order for Products offered on the Site implies consultation and express acceptance of the following Terms and Conditions, without, however, said acceptance being conditional on a hand-signed signature by the User. The compilation and sending of the order form (referred to in point 7) constitutes for all legal purposes a contract between Argoing srl and the User, from which mutual rights and obligations governed by civil law arise.
The natural person User declares to be of age.
Modification of the Terms and Conditions
Argoing srl reserves the right to change and/or modify the following Terms and Conditions at any time. Therefore, we invite you to check any changes that may be made. If you do not agree to any of the Terms set out below, please simply stop using the website at any time. 2. Website Content
All contents of the website ("Content") are the property of Argoing srl and are protected by Italian, EU and international law on copyright, trademarks, patents, or other intellectual property laws. Argoing srl holds the copyright in the selection, compilation, assembly, arrangement and enhancement of the contents on the website.
3. Use of the Site
Subject to your compliance with these terms, you are granted permission to download, view, use and/or print from the website for your personal use only, not for the purposes of your commercial and or professional activities. Any other use is totally prohibited without prior authorization from Argoing srl
4. Information on Products and Prices
The Products that Argoing srl offers for sale are those listed on the Site and on the date on which the Users consult the Site itself within the limits of the stock made available by the suppliers.
At the discretion of Argoing srl, price and product information may be subject to change at any time without notice. Argoing srl does not provide any declaration or guarantee regarding the accuracy or completeness of the information on the website. There may be information on the Website that contains typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, promotions, offers and availability. Therefore, Argoing srl cannot be held responsible for any errors and/or discrepancies in the products. Argoing srl reserves the right to correct any errors, inaccuracies or omissions and to change or update information or cancel orders if any information on the website is inaccurate. Argoing srl strives to display the colors of the products as accurately as possible, however, we cannot guarantee the display of any color on your particular computer monitor or device.
Argoing srl assumes no responsibility for payments due by the User for all products ordered on the website. If Argoing srl does not receive payment from the credit card issuer or its agents, the User agrees to send the payment through another payment method. You are responsible for any additional costs caused by late payments.
Delivery costs are adequately highlighted at the time of ordering. The amount of the cost of each shipment may vary based on the delivery and payment method, as well as on the destination and amount of the order.
5. How to enter and confirm the order
Users can view and choose the Products marketed by Argoing srl on the Site. Users can consult the various pages of the Site for free, without any obligation to purchase.
The purchase contract is concluded through the exact compilation of the individual purchase request boxes and the forwarding of the forms themselves together with the consent, after viewing the order summary via a printable web page, which shows:
the details of the person placing the order and the order, the price of the goods purchased, the shipping costs and any additional charges, the payment methods and terms, the address where the goods will be delivered and the delivery times.
The correct receipt of the User's proposal is confirmed by Argoing srl through an automatic response sent to the email address communicated by the User and only confirms the correct receipt of the proposal within the information systems. This confirmation message will indicate an "Order Number", to be used in any subsequent communication with Argoing srl. The message will re-propose, in addition to the information required by law, all the data entered by the User who undertakes to verify its correctness and to promptly communicate any possible correction. Possible additional costs caused by errors in the data not reported promptly will be the sole responsibility of the User.
6. Payment Methods.
All payments must be made immediately through the website.
Debit and credit cards - After creating an order, you will be redirected to the bank's payment gateway, where you can enter the necessary payment details. This method of paying the purchase price is considered an advance payment. We would also like to inform you that our employees do not have access to your card details. Everything is exclusively managed by the bank.

PayPal - after creating an order, you will be redirected to a secure PayPal gateway, where you will log in to your PayPal account to complete your purchase. We wish to inform you that Argoing srl does not have access to your PayPal account or any other information relating to your PayPal account.
In order to protect you and Argoing srl from fraud, only items to confirmed PayPal addresses linked to your PayPal account will be shipped. If you are unsure about your address confirmation, please visit the PayPal link provided and follow the confirmed address verification instructions.
7. Shipping and delivery
Argoing srl will do everything possible to have each delivery sent as quickly as possible. For delivery times in Italy, please consider an average of fifteen working days after shipment; in any case, orders will still be delivered within 30 days maximum, depending
of the origin of the goods and the type of shipping service chosen by the User, and start from the date of confirmation of the order by the User.
The shipment will be made to the address indicated at the time of registration or purchase by the User, who undertakes to indicate a valid and correct address.
8. Sales Tax
Prices and products are indicated in Euros and include VAT.
9. Returns
All products supplied by us conform to the descriptions provided on this website.
In the event that a defective or malfunctioning product is delivered, for Users who cannot be qualified as consumers pursuant to the consumer code, it is possible within 30 days to request authorization to return the product to the following email address info @argoingshop.it , also requesting a refund of the sales price or, optionally, replacement with another product of the same value. This 30 day period will begin the day after you receive the product.
Consumer Users pursuant to the Consumer Code, in the event of delivery of defective or malfunctioning products, have the right within two months to request authorization for return to the following email address info@argoingshop.it , also requesting reimbursement of the sales price or, optionally, replacement with another product of the same value. This two-month period will begin to run from the day the defect or malfunction is discovered.
We invite you to contact us if you receive a damaged product and we invite you to send us any photographic evidence to support your compensation request.
If the aforementioned conditions are respected, the Argoing srl Customer Service will then proceed with the credit or with the possible sending of a new order for the replacement of the defective material. Argoing srl will in no case be held responsible for any type of direct or indirect damage resulting from the indiscreet use of the goods.
The actual return can only take place in the following ways: sending the defective product for which return authorization has been requested to the address indicated in the packaging received by courier. The product must be returned in its original packaging accompanied by the tag found on the bottom of the invoice and the transport document. The product must be returned intact in all its parts and complete with any additional components, in the same conditions and in the same composition in which it was packaged and shipped.
The transport costs will be borne by Argoing srl only if the decision to return the Products derives from an error on the part of Argoing srl itself
All products are guaranteed according to the respective supplier's warranty.
Argoing srl does not grant refunds or replacements for products that have caused an allergic reaction. If the User experiences an allergic reaction from the use of the product we invite him to stop using it immediately. Argoing srl is not responsible for allergic reactions caused by the products it markets as the User should be aware of which products or ingredients he or she is allergic to or not.
If you wish to return damaged or faulty products, Argoing srl will organize collection via a courier. Please note that collection can only be scheduled once. In case of unsuccessful collection, the return of the shipment will be borne by the User.

10. Withdrawal
The User who can be considered a "consumer" pursuant to Legislative Decree 206/2005 (Consumer Code) has the right
to withdraw from the purchase contract for any reason and without providing explanations, under the conditions set out below. The following does not, therefore, concern relationships with Users who cannot be classified as consumers; these relationships will be governed by current law regarding withdrawal and termination.
The consumer user has the possibility to exercise the right of withdrawal within 14 working days, starting from the day after receiving the product and to receive a refund of the price even if the product has no defects.
This right is subject to certain conditions and limitations (please read below).

The right of withdrawal is subject to the condition that the product has not been used and is returned in its original packaging, in the times and methods described above. The product must be returned intact in all its parts and complete with any additional components, in the same conditions and in the same composition in which it was packaged and shipped.
The User who exercises the right of withdrawal must return the goods purchased without undue delay and in any case within 14 working days from the date on which he communicated his decision to withdraw.
In the event of cancellation of an order due to the exercise of the right of withdrawal, the shipping costs are the sole responsibility of the User
Argoing srl processes money refund plans within 30 working days starting from the date on which the purchased product was received by Argoing srl; this only following verification of the regularity of the procedure and the originality of the packaging and of the product itself in all its components.
It is not possible to exercise the right of withdrawal for sealed products that are not suitable for replacement for hygienic reasons or related to health protection and which have been opened after delivery.
The product must be returned in its original packaging accompanied by the tag found on the bottom of the invoice and the transport document.
We invite you to take reasonable care of the product before returning it - in particular, the products must not have been damaged.

11. Discounts
Customers who cannot be configured as consumers pursuant to and for the purposes of Legislative Decree 206/2005 and who, therefore, purchase as Professionals, being in possession of a VAT number, will be able to benefit from a discounted price on purchase goods exceeding 100 pieces.
In order to access this service it will be necessary to indicate the name or company name at the time of registration, as well as the VAT number and, consequently, a specific discount code [SC2] will be provided .
12. Major force
Neither Party will be responsible for total or partial non-performance or delay in the execution of its obligations under this contract which are caused by an event that cannot be prevented (Force Majeure).
Force majeure events may include, but are not limited to, wars, riots, insurrections, serious disturbances in internet security, technical failures, unauthorized access and/or intrusions into the website, strikes of any form, IT failures. or telephone.
13. Applicable law
The general conditions of sale and the contractual relationships existing between Argoing srl and the Buyer are governed by Italian law.
For any dispute that may arise in connection with this contract, Users may activate an extrajudicial dispute resolution procedure compliant with the requirements set out in the articles. 141 et seq. of the Consumer Code. In the event that the User activates the aforementioned procedure, participation in an attempt at a friendly settlement is guaranteed which the User can promote before RisolviOnline, an independent and institutional service provided by the Arbitration Chamber of the Milan Chamber of Commerce.
The User also has the right to make use of the online dispute resolution procedure available at http://ec.europa.eu/consumers/odr
14. Personal account
We are happy to make it easier for you to order products using our website, therefore we offer you the possibility to register with a personal account. Thanks to this opportunity, all the personal data you provide will be stored in our database and for each new order you will not need to enter them again - as an automatic order form will be created.
To register you must complete the online registration form. You can access, update or correct your personal account information through the “My Personal Information” feature. We will use the stored data in accordance with the privacy legislation as per the relevant information.
You are responsible for maintaining the confidentiality of your password and username, and you will be responsible for all activities that occur. As we do not have the means to check the identities of people using the website we will not be liable if your password or username is used by someone else unless this is due to our negligence. The user undertakes to immediately communicate via e-mail info@argoingshop.it if he becomes aware of or suspects any unauthorized use of his password or username.
15. Protection of confidentiality and processing of User data
Argoing srl protects the privacy of its customers and guarantees that the processing of data complies with the provisions of the privacy legislation pursuant to Legislative Decree. 2003/196. The personal, demographic and fiscal data acquired directly and/or through third parties by Argoing srl, data controller, are collected and processed in paper, electronic and telematic form, in relation to the processing methods, as per the information released and published on the website at 'address www.argoingshop.it .
The User enjoys the rights referred to in the art. 7 of the Legislative Decree. 196/2003.
16. Digital invoice
The User will receive the digital invoice via email, which he can download at any time. The digital invoice is also accessible from the User's account section, or can be requested by writing to info@argoingshop.it.
17. Partial disability
If one or more clauses of these General Conditions of Sale are deemed invalid or declared as such pursuant to law, regulation or by virtue of a final judgment, all other clauses will remain fully valid.
